On Friday the 13th, the Obama Administration in a joint letter by the Department of Education and Department of Justice informed school districts how the two agencies will determine whether schools receiving federal funds are complying with Title IX of the Education Amendments of 1972 (Title IX). Title IX prohibits discrimination on the basis of sex in education programs. The letter states Title IX includes discrimination based on a student’s gender identity and that schools must not treat a transgender student differently from the way it treats others of the same gender identity. For example, schools must allow transgender students to use restrooms and locker rooms consistent with their gender identity. If schools do not comply as determined by the agencies, they stand to lose federal funds.
“The threat of losing federal funds does not sit well with us in Wyoming. Education is rightly controlled by our local school districts and they deal everyday with matters that affect student safety and privacy,” said Governor Mead. “I have confidence Wyoming schools will find a way forward that is respectful of all students. The Administration’s letter, which is flawed, includes deeply divisive analysis and policy guidance that is not helpful. We will continue to honor local control and we will resist this latest action by the Administration.”
